By using the Daycare Spots Site, mobile App, or Services (as defined below), you agree to our processing of personal data that you submit or that you may provide when you visit our website, www.daycarespots.com (“Site”) or In email, text, other electronic messages, or phone calls between you and this Site, or our employees or agents or when you access and use the Mobile Application or any of our Services. YOUR USE OF THE SITE, MOBILE APPLICATION OR SERVICES CONSTITUTES YOUR AGREEMENT TO THIS PRIVACY POLICY. WE ENCOURAGE YOU TO READ THE FOLLOWING IN ITS ENTIRETY PRIOR TO BROWSING OUR SITE, ACCESSING THE MOBILE APPLICATION, USING OUR SERVICES, OR OTHERWISE CONDUCTING BUSINESS WITH US. We use your Personal Information for providing and improving the Site, Mobile Application, and Services. By using the Site, Mobile Application or Services, you agree to the collection and use of information in accordance with this Privacy Policy. Your use of our Site or Services, and any dispute over privacy, is subject to this Privacy Policy and our Terms of Use, including its applicable limitations on damages and the resolution of disputes. Your use of Daycare Spot's Services are at all times subject to our Terms of Use, which incorporates this Privacy Policy and which you can access here Terms Of Use. Any terms we use in this Privacy Policy without defining them have the definitions given to them in the Terms of Use.

This Privacy Policy does not apply to information collected by or through any third party, companies we do not own, or people we do not manage, including through any government entity website or database, daycares, vendors, applications or content (including advertising) that may link to or be accessible from or on the Site, Mobile Application or the Services.

Please note that this Privacy Policy is intended to apply to visitors to our Site and clients of Daycare Spots. Depending upon your relationship with Daycare Spots some of the information below may not apply to you.

Commitment to Privacy

We are a company committed to protecting the privacy of individuals who visit the Site (“Visitors”), individuals and companies associated with organizations who register to use the Services as defined below (“Users”). Visitors and Users are collectively referred to in this Privacy Policy as “you” and “your” or as “User(s)”. This Privacy Policy (“Privacy Policy”) describes Daycare Spot’s privacy practices in relation to the use of Daycare Spot’s public Site at www.daycarespot.com and the portals or functionality made available to Users in connection with the Services offered by Daycare Spots, including, but not limited to, our Daycare Providers database, User dashboards, Vendor locator, job postings, requests for services, community forums, and parent resources (collectively, the “Services”).

Information We Collect About You

We collect several types of information from and about Users of our Site and Services, including information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or household, or that constitutes “personally identifiable information” under applicable data privacy laws, rules or regulations (collectively “Personal Information”). How We Collect Personal Information

We collect this Personal Information:

  • Directly from you when you provide it to us, or our employees, Service Providers (as defined below in “Information We Collect From Third Parties”) or agents;
  • Automatically as you navigate through the Site, Mobile Application, or Services. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies (as defined in the “Information We Collect Through Automatic Data Collection Technologies” section below);
  • Public Records; and
  • From third parties (for example, our business partners or Service Providers (as defined below in “Information We Collect From Third Parties”)).

This Personal Information is required to provide Services to you. If you do not provide Personal Information we ask for, it may delay or prevent us from providing Services to you.

Information You Provide to Us
The information we collect on or through our Site or Services may include:

  • Information that you provide by filling in forms on our Site or the Services. This includes information provided at the time of creating an account or registering to use our Site or the interactive tools and Services, subscribing to our Services, posting material and/or Content, or requesting further services. We may also ask you for information when you access Promotional Discounts or Free Trials, or when you report a problem with our Site or the Services.
  • Records and copies of your correspondence (including email addresses), if you contact us.
  • Your responses to surveys or questionnaires that we might ask you to complete for research purposes.
  • Details of transactions you carry out through our Site or Services and of the fulfillment of your tour requests, RFQs, subscription terms, or orders. You may be required to provide financial information before placing a request, RFQ, or order through our Site or signing up for our Services.
  • Your search queries on the Site or the Services.
  • If you download and install certain applications or software we make available, we may receive and collect information transmitted from your device for the purpose of providing you the Services, such as information regarding when you are logged on and available to receive updates or alert notices.

You also may provide information to be published or displayed (hereinafter, "posted") in online forums on the Site or the Services, on public areas of the Site, or transmitted to other Users of the Site or Services, or to third parties (collectively, "User Contributions"). Your User Contributions are posted on and transmitted to others with your consent and at your own risk. Please be aware that no security measures are perfect or impenetrable. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons.

Information We Collect Through Automatic Data Collection Technologies
As you navigate through and interact with our Site or use our Services, we may use automatic data collection technologies to collect certain information about your equipment, browsing actions, and patterns, including:

  • Details of your visits to our Site or use of the Services, including traffic data, location data, logs, and other communication data and the resources that you access and use on the Site or Services.
  • Information about your computer and internet connection, including your IP address, operating system, and browser type.
  • If you download our mobile application or use a location-enabled browser, we may receive information about your location and mobile device, as applicable.

The information we collect automatically does not include Personal Information, and we may maintain it or associate it with information we collect in other ways or receive from third parties. It helps us to improve our Site and Services and to deliver a better and more personalized service, including by enabling us to:

  • Estimate our audience size and usage patterns.
  • Store information about your preferences, allowing us to customize our Site and Services according to your individual interests.
  • Speed up your searches.
  • Recognize you when you return to our Site.

The technologies we use for this automatic data collection may include:

  • Daycare Spots’s Service Providers
    • We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used, including but not limited to, use of our own Service Providers to obtain information to generate leads and to create user profiles. These third parties have access to your Personal Information only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.
  • Social Networks
    • If you provide your social network account credentials to us or otherwise sign-in to the Services through a third-party site or service, some content and/or information in those accounts may be transmitted into your account with us.

Third-Party Use of Cookies and Other Tracking Technologies

Some content or applications, including advertisements, on the Site are served by third-parties, including advertisers, ad networks and servers, content providers, and application providers. These third parties may use cookies alone or in conjunction with web beacons or other tracking technologies] to collect information about you when you use our Site. How We Use or Sell Your Information

We use or sell information that we collect about you or that you provide to us, including any Personal Information for the following Commercial or Business Purposes:

  • To provide our Site and Services to you, to create and manage your account, profile or other User profiles or dashboards, to communicate with you about your use of our Site or Services, to respond to your inquiries, and for other customer service purposes, which may include communicating with you via email, text or phone;
  • To better understand how Users access and use our Site and Services, both on an aggregated and individualized basis, to improve our Site and Services and respond to user desires and preferences, and for other research and analytical purposes;
  • To tailor the content and information that we may send or display to you, personalized help and instructions, and to otherwise personalize your experiences while using the Site or Services;

For example, we may use your information, such as your email address, to send you news and newsletters, special offers, and promotions, or to otherwise contact you about products or information from us or from our partners that we think may interest you. Except as disclosed in this Privacy Policy, we do not sell, trade, rent, or otherwise retransmit any Personal Information we collect online unless we have your permission. Any Personal Information you provide to us will be stored in our US databases or with our third-party vendors who process our credit ++++card and related operational transactions in the United States of America.

How We Share, Sell or Disclose Your Personal Information

We may share, sale or disclose aggregated information about our Users, and information that does not identify any individual, without restriction.

We routinely share with or disclose Personal Information to:

  • To our subsidiaries and affiliates;
  • Service Providers we use to help deliver our products and/or services to you, such as payment processing, page view analytics, authentication, cloud storage, website or software based support chat, cookie consent, error handling, customer support, and contractors or agents, including, but not limited to:

Choices About How We Use, Sell and Disclose Your Information

We strive to provide you with choices regarding the Personal Information you provide to us. While we would like to collect data to improve our Services and to send you information about products and services which may be of interest to you, you have a right at any time to stop us from tracking or contacting you for marketing, advertising and promotional offer purposes or giving your information to our Affiliates, unaffiliated or non-agent third parties, Service Providers or other Users of our Services. If you have already consented to tracking tools, receiving marketing, advertising or promotional offer information, you may change or control your permissions, or opt out at any time. We have created mechanisms to provide you with the following control over your information:

  • Marketing and Promotional Offers from Daycare Spots. If you do not wish to have your contact information used by Daycare Spots for marketing purposes or to promote our own or third parties' products or services, you can opt-out by sending us an email with your request to privacy@daycarespots.com or mailing a written request to the address provided in the “How to Contact Us” section below, or click UNSUBSCRIBE the next time you receive an email or text from us that provides that option. If we have sent you a marketing or promotional email, you may send us a return email asking to be omitted from future email distributions. This opt out does not apply to information provided to Daycare Spots as a result of a subscription purchase, registration, service experience or other transactions.
  • Targeted Advertising. If you do not want us to use or sell information that we collect or that you provide to us to deliver advertisements according to our advertisers' target-audience preferences, you can opt-out by sending us an email with your request to privacy@daycarespots.com or mailing a written request to the address provided in the “How to Contact Us” section below.

We may ask you to confirm or update your marketing preferences if you instruct us to provide further services in the future, or if there are changes in the law, regulation, or the structure of our business.

We do not control third parties' collection or use of your information to serve interest-based advertising. However, these third parties may provide you with ways to choose not to have your information collected or used in this way. Do Not Track

Certain web browsers and other devices you may use to access the Site or Services may permit you to indicate your preference that you do not wish to be “tracked” online. At this time, neither the Site nor Services respond to “Do Not Track” signals.

Daycare Spots provides links to other entities related to the Services for your convenience in locating certain information, Services, and / or products, including, but not limited to, the Daycare Providers, Vendors or our Service Providers. Please be advised that when you access these other sites, you are leaving the Daycare Spots Site and / or Service(s) and that these third-party sites are maintained by organizations over which Daycare Spots has no ownership or control. Accordingly, a link provided by Daycare Spots does not constitute endorsement of the content, viewpoint, policies, legality, products, or services provided or advertised on the third-party site. Once you link to a site not maintained by Daycare Spots, you are subject to the terms and conditions of that site and all inquiries regarding such third-party sites or services should be directed to the owner of such site or services, not Daycare Spots. You further acknowledge and agree that Daycare Spots shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such websites or services. We strongly encourage you to read the terms and conditions and privacy policies of any third party websites or services that you visit or engage with.

Social Media

If you post material or Content to a blog or other social media feed located on or accessed through the Services, you should be aware that any Personally Identifiable Information you submit can be read, collected, or used by other Users of this Site or our Services, and could be used to send you unsolicited messages. We are not responsible for the Personally Identifiable Information you choose to submit via social media or any other publicly-available forum, online or not.

Privacy Rights in other States and Countries

If you live in or one of the 48 States that isn’t Texas, or in a foreign country, you may also have unique privacy or data rights. Accessing and Correcting Your Information

You have the right to be informed of what information we may have, how we process it for business purposes, and how we store it. Reading this Privacy Policy carefully will provide all such explanations, but if you are having trouble finding it yourself within this document, you may contact us directly. You also have the right to contact us and inquire if we have any information about you, and how any such information is or has been used over the past 12 months. Specifically, we will provide you with the following information:

  • The categories of Personal Information that we have collected about you.
  • The categories of sources from which that Personal Information was collected.
  • The business or commercial purpose for collecting or selling your Personal Information.
  • The categories of third parties with whom we have shared your Personal Information.
  • The specific pieces of Personal Information that we have collected about you.

Further, if we have disclosed your Personal Information to any third parties for a business purpose over the past 12 months, we will identify the categories of Personal Information shared with each category of third party recipient. If we have sold your Personal Information over the past 12 months, we will identify the categories of Personal Information sold to each category of third party recipient.

We will do our best to respond to any such inquiries in a timely manner. If you make an inquiry, please understand that it is very well possible that we will have no information associated with you because our information collection and processing methods seek to minimize the information we collect, and much of the information we collect cannot readily be associated with a particular human being.

You have the right to correct any personal information or data we do possess about you. Who wants incorrect personal information or data?? Not us, and not you either! You can review, change or correct certain personal information, and User Contributions by logging into the Site or Services and visiting your account profile page.

Please be advised that if you delete your User Contributions from the Site or Services, copies of your User Contributions may remain viewable in cached and archived pages or might have been copied or stored by other Site or Services users. Proper access and use of information provided on the Site or Services, including User Contributions, is governed by our Terms of Use.

Regardless of whether you choose to review, change, or correct your Personal Information yourself as described above, in the event that any of your Personal Information is incorrect, you may also request that we correct the information for you or discontinue processing of your Personal Information or data.

You also have the right to contact us and request that we simply erase or delete any information associated with you. (Please note that if you are a paying User of Daycare Spots, such a request will require conversation, as certain information such as how we can contact you cannot practicably be deleted while we are doing business together.) We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.

You also have the right to object to our use of your Personal Information. If you wish to submit an objection, you must provide an explanation for your objection so we can determine how to best service your request.

How to Exercise Your Rights

To exercise the rights described above, you or your Authorized Agent (defined below) must send us a request that (1) provides sufficient information to allow us to verify that you are the person about whom we have collected Personal Information, and (2) describes your request in sufficient detail to allow us to understand, evaluate and respond to it, including whether you are submitting an inquiry, rectification request, objection or explanation. Each request that meets both of these criteria will be considered a "Valid Request." We may not respond to requests that do not meet these criteria. We will only use Personal Information provided in a Valid Request to verify your identity and complete your request. You do not need an account to submit a Valid Request.

We will work to respond to your Valid Request within 45 days of receipt. We will not charge you a fee for making a Valid Request unless your Valid Request(s) is excessive, repetitive or manifestly unfounded. If we determine that your Valid Request warrants a fee, we will notify you of the fee and explain that decision before completing your request.

You may also authorize an agent (an "Authorized Agent") to exercise your rights on your behalf. To do this, you must provide your Authorized Agent with written permission to exercise your rights on your behalf, and we may request a copy of this written permission from your Authorized Agent when they make a request on your behalf.

How We Protect Your Information

While the security of your Personal Information is important to us, and we use industry-standard precautions to safeguard your Personal Information, we cannot guarantee complete security. Please remember that 100% complete security, regardless of the method of transmission over the Internet, or method of electronic storage, does not presently exist anywhere online or offline.

We have implemented measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. Access to your Personal Information is restricted. Only employees who need access to your Personal Information to perform a specific job are granted access to your Personal Information. Finally, we rely on third-party service providers for the physical security of some of our computer hardware. For example, when you visit our Site or Services, you access third-party servers that are kept in a secure physical environment, behind a locked cage and an electronic firewall.

To protect your Personal Information from unauthorized access by third parties, Daycare Spots utilizes reasonable security procedures and policies, including network segmentation, encryption, and intrusion prevention. If Daycare Spots becomes aware of a security breach related to Personal Information, Daycare Spots will (i) notify those affected in compliance with applicable laws or as soon as reasonably possible; (ii) take prompt action to mitigate any harm flowing from such breach; and (iii) take prompt action to prevent any further breaches from occurring, including, where appropriate, the installation of appropriate software patches.

You should take steps to protect against unauthorized access to your password, phone, and computer by, among other things, signing off after using a shared computer, choosing a robust password that nobody else knows or can easily guess, backing up your emails, and keeping your log-in and password private. We are not responsible for any lost, stolen, or compromised profiles, dashboards, emails, usernames, passwords or for any activity on your account via unauthorized password activity.

How Long Your Personal Information Will Be Kept

We retain Personal Information about you for as long as you have an open account with us or as otherwise necessary to provide you with our Services. In some cases we retain Personal Information for longer, if doing so is necessary to comply with our legal obligations, resolve disputes or collect fees owed, or is otherwise permitted or required by applicable law, rule or regulation. We may further retain information in an anonymous or aggregated form where that information would not identify you personally. When it is no longer necessary to retain your Personal Information, we will delete or anonymize it.

Our Commitment to Children’s Privacy

Daycare Spots is committed to protecting the privacy needs of children, and we encourage parents and guardians to take an active role in their children’s online activities and interests. We are in compliance with the requirements of COPPA (Children’s Online Privacy Protection Act). None of our Services, the Site or the mobile application, are directed to children under 13 years old, and we do not market to or knowingly collect any Personally Identifiable information from a child under the age of 13 without the consent of the child’s parent or legal guardian.
